With the growth of population and the expansion of commercial, industrial, residential and leisure land, Canada has attracted a large number of foreign properties. Under the Federal Citizenship Act, non-Canadian residents can also purchase, own and sell real estate under the same requirements and conditions as Canadian residents or citizens. However the law also gives provinces the power to restrict the acquisition of land by non-citizens and non-residents or by companies and associations controlled by them.

In Ontario, the Alien Real Estate Act gives non-Canadian citizens the right to own or sell real estate. However, under the Provincial companies Administration Act, companies incorporated in jurisdictions outside Ontario must obtain permission to purchase, own or transfer real estate in Ontario. But such a license is easy to obtain.

In Quebec, under the non-resident Farm Land purchase Act, non-residents are not allowed to purchase farm land in the province without the approval of the Quebec Agricultural Land Protection Commission. The committee is responsible for the protection of agricultural land in Quebec. Several other provinces have similar restrictions to protect agricultural land.

Canadian provinces and territories can handle real estate insurance policies issued by major American property insurance companies and certified by the American Land Rights Association for real estate mortgage lenders and real estate owners at any time. In Ontario, the Planning Act sets out the main principles for government control of land development and use. Most municipal governments require that the location plans of newly developed construction projects must be approved before they can start construction. The location map determines the details of the building development project (including the building site and related facilities such as landscaping, services, lanes and parking spaces). Most municipalities also require developers to sign agreements to ensure that construction works and future repairs are in line with the location map.
